The purpose of these General Conditions of Sale is to define and regulate, exclusively, the contractual relations established between the users of www.joanasimoes.com and Joana Simões – Joalharia de Autor®.
The terms and conditions described below apply to purchases of all products from the online store www.joanasimoes.com, owned by Joana Simões.
Joana Simões – Joalharia de Autor® can punctually change certain provisions of its General Conditions of Sale, so they should be read by the Customer at each visit promoted to the site www.joanasimoes.com
The Customer shall not confirm any request formulated on the Site if it does not consider itself enlightened and properly informed regarding the content and scope of the General Conditions of Sale.
ORDER
All orders and purchases made on this Site and accepted by Joana Simões – Joalharia de Autor® are subject to the aforementioned General Conditions of Sale. The order’s formalization will imply the acceptance of these Conditions.
After you place your order, you must make sure that you receive an email confirming your order. During the process you will receive further notifications through this way.
PRICES
The prices shown on the Site are defined in Euros (€), with taxes included at the current rate (VAT at this moment of 23% in Portugal).
The prices are thus considered valid, except in the case of errors or omissions, such as computer errors or introduction.
Joana Simões – Joalharia de Autor® reserves the right at any time and unilaterally to change the price of articles presented on the Site, without prior notice.
DEADLINES
The time delivery of orders depends on the availability of stock jewellery and the complexity of the order, which is the case of custom jewellery. Thus, the greatest shipping period is 5 business days for most orders, and up to 12 business days for personalized orders.
However, depending on the number of orders and the complexity of it, the order may be delayed.
In this case, we will immediately get in contact with a new estimated delivery period and offering the possibility to cancel the order, without any compensation being paid to any party for breach of contract or damages.
Please note that delivery times may be a little longer during festive periods.
PAYMENT METHODS
You may choose one of the following payment methods:
Paypal: You will be redirected to the site of Paypal, and must follow the instructions provided until completion of the payment.
Credit Card: You can pay by Credit Card
All articles will remain the property of Joana Simões until the payment is confirmed.
SEND
During the purchase process at www.joanasimoes.com you will be asked for the addresses for invoicing and delivery. For security reasons, we do not ship to sections.
It is important that the data is filled in completely and correctly to ensure successful delivery. Once your order is shipped, you will receive an email with shipping information.
Free Portugal shipping costs. World shipping costs with a 4,5€ fee and free for orders higher than 50€.
All shipments to national and international territory will be made via CTT (Portuguese Post Office), in Registered Mail, to the address indicated by the Customer.
In case of loss, Joana Simões – Joalharia de Autor® undertakes to reimburse the Customer for the full amount of his order, unless the Customer indicates an incorrect element of his responsibility.
NATIONAL EXPEDITIONS
The estimated delivery time is 24 working hours, after dispatch. If there is no one to receive the order at the shipping address, a document will be left to pick up the order at the nearest CTT Station, within the period indicated.
In the event that the order is returned to Joana Simões – Joalharia de Autor® for not being timely picked up at the CTT station, the re-shipment will only be made upon payment of the costs of re-sending.
INTERNATIONAL EXPEDITIONS
For information on international deliveries to countries that are not on the list for which Joana Simões – Joalharia de Autor® makes an online shopping expedition, please contact us at costumerservice@joanasimoes.com.
Please note that International orders may be subject to customs duties or import duties at the time of placing the order in your country. We are not aware of these rates and can not predict their value since they differ from country to country. You should contact local authorities for more information.
EXCHANGES
After receiving your order, the Customer has 14 days to make an exchange, from the same’s date receipt.
You should send an email to costumerservice@joanasimoes.com to receive all the information. You can not exchange custom articles.
RIGHT OF FREE RESOLUTION
Under Decree-Law no. 24/2014, the Customer has a period of 14 days to exercise his right of free resolution of the contract, from the order’s receipt date.
In order to exercise your right of free resolution, you must notify us of your decision through email to costumerservice@joanasimoes.com. Custom items can not be returned.
WARRANTY
Under legal terms, the Joana Simões – Joalharia de Autor® jewellery are guaranteed for 2 years. The warranty period starts on the printed date of your proof of purchase, which must be presented for the proper effect.
Defects arising from improper or abusive use, normal wear and tear, and the following situations (loss, deterioration, oxidation, improper maintenance and cleaning, improper handling, negligence and accidents) are excluded from the guarantee.
The use marks, as a result of daily activity and the passage of time, are considered normal by the Brand.
All the Joana Simões – Joalharia de Autor® jewellery are individually produced through manual processes. In this way, there may be slight variations between the photographs of the jewels you see on the Site and the jewelry you will receive.
We will do everything in our power to prevent this from happening, however, within the limits of the Portuguese law, Joana Simões – Joalharia de Autor® is not responsible for losses, direct or indirect, regarding the accuracy of the Site’s content.
